Vitavia™ ("Vitavia," "we," "us," or "our") is an independently operated brand providing products through a direct-to-consumer model. Our website and online store (the "Site") and related products and services (the "Services") are operated by Vitavia and powered by Shopify Inc. Vitavia is an independent entity and is not owned or operated by Shopify.
By accessing or purchasing from Vitavia, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, Refund & Return Policy, and Shipping Policy. These Terms constitute a legally binding agreement between you and Vitavia. If you do not agree to all terms, you must not use our Services.
1. Eligibility & Account
You must be at least 18 years old to use our Services. You agree to provide accurate, current, and complete information during checkout or account creation. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Vitavia reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion, especially in cases of suspected fraud, abuse, or unauthorized activity.
2. Products & Disclaimers
All product descriptions, images, and information provided on the Site are for general informational purposes only. Vitavia strives for accuracy but does not warrant that product descriptions, pricing, or other content is error-free.
- Health & Wellness Products: Certain products sold on the Site may be classified as dietary supplements or health-related products. Statements regarding such products have not been evaluated by the U.S. Food and Drug Administration (FDA) or equivalent regulatory bodies. These products are not intended to diagnose, treat, cure, or prevent any disease. Customers are encouraged to review product ingredients, directions, and warnings carefully and to consult a qualified healthcare professional before use.
- Individual Responsibility: Customers are responsible for verifying that products and their ingredients are appropriate for their personal circumstances, including but not limited to allergies, sensitivities, pre-existing conditions, or interactions with medications. Vitavia is not liable for adverse reactions arising from personal sensitivities, pre-existing conditions, misuse, or failure to follow product directions.
- Product Condition: Vitavia is not responsible for product degradation or damage caused by improper storage, handling, or misuse after delivery.
3. Orders & Payment
All orders constitute an offer to purchase. Vitavia reserves the right to limit quantities or refuse any order for any reason.
- Pricing & Currency: All prices are displayed in the currency indicated at checkout. We reserve the right to correct any pricing errors or inaccuracies at any time, even after an order has been submitted. In such cases, we may cancel the order and issue a refund.
- Billing: You authorize Vitavia to charge your selected payment method for the total order amount, including applicable taxes, duties, and shipping fees.
- International Orders: International customers are responsible for all customs duties, import taxes, brokerage fees, and compliance with local import regulations. Vitavia is not responsible for additional charges imposed by customs or carrier authorities in the destination country.
4. Subscription Terms (Auto-Renewal)
By enrolling in a subscription, you agree to recurring charges at the frequency and price disclosed at the time of enrollment.
- Cancellation: You must cancel at least 72 hours before your next scheduled billing date to avoid being charged for the next cycle. You may cancel by contacting customer support or using your account (where available).
- Refunds: Processed renewal orders are non-refundable once processing has begun.
- Changes: Vitavia reserves the right to modify subscription pricing or terms with reasonable advance notice. Continued enrollment after such notice constitutes acceptance of the updated terms.
5. Shipping & Delivery
U.S. Orders: Shipping is available to all 50 U.S. states. All orders are subject to carrier handling once shipped. Delivery estimates are not guaranteed.
International Orders: Vitavia ships to select international destinations. International delivery times may vary and are subject to customs processing. Vitavia is not responsible for delays, seizures, or additional fees imposed by customs authorities.
Shipping events such as delay, loss, theft, or misdelivery may be subject to carrier investigation and carrier policies. If an order is marked as delivered but cannot be located, customers should contact us promptly so we can help guide the next steps where applicable. 6. Returns, Refunds & Money-Back Guarantee
Returns and refunds are governed by our Refund & Return Policy. Key terms include:
- Unopened products may be returned within 30 days of delivery.
- Opened or used products cannot be returned under the standard return policy.
- Select products are covered by our Money-Back Guarantee (30 or 60 days, as specified on the product page). No return is required; refund covers the product purchase price only, excluding shipping fees.
- Damaged, defective, or incorrect items must be reported within 7 days (U.S.) or 14 days (international) of delivery.

7. Intellectual Property
All content on the Site, including but not limited to trademarks, trade names, logos, product names, text, images, graphics, and designs, is the exclusive property of Vitavia™ or its licensors. No part of the Site may be reproduced, distributed, modified, or used for commercial purposes without our express written consent.
Vitavia's trademarks include but are not limited to: Vitavia™, Gentle Science™, Triple-Axis Formula™, and Pink Harmony™. Use of these marks without authorization is strictly prohibited.
8. User Content & Reviews
By submitting a review, testimonial, or other content to the Site, you grant Vitavia a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and display that content for marketing and promotional purposes across any media.
Vitavia reserves the right to remove, edit, or refuse to publish any user content that is inaccurate, misleading, defamatory, inappropriate, or that violates applicable laws or regulations.
9. Prohibited Uses
You agree not to:
- Use the Services for any unlawful, fraudulent, or unauthorized purpose
- Infringe on Vitavia's intellectual property or the rights of any third party
- Transmit malicious code, viruses, or any harmful software
- Engage in automated data collection, scraping, or crawling without written consent
- Attempt to gain unauthorized access to any part of the Site, servers, or systems
- Interfere with or disrupt the operation of the Services
- Misrepresent your identity or affiliation with any person or entity
10. Disclaimer of Warranties
The Site and Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Vitavia does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or harmful components. We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Vitavia and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Services or products.
In no event shall Vitavia's total cumulative liability to you for any claims arising out of or related to these Terms or the Services exceed the actual amount paid by you for the specific product(s) giving rise to the claim in the 12 months preceding the incident.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, Vitavia's liability shall be limited to the fullest extent permitted by applicable law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Vitavia, its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of the Services or products; (c) your violation of any applicable law or regulation; or (d) any content you submit to the Site.
13. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Vitavia's principal place of business is located in Alberta, Canada.
Nothing in these Terms limits any consumer protection rights that cannot be waived or limited under the laws of your jurisdiction of residence.
14. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation between the parties. If a resolution cannot be reached within 30 days, disputes shall be finally settled by binding individual arbitration administered in the Province of Alberta, Canada, in accordance with the Arbitration Act (RSA 2000, c A-43) of Alberta, rather than in court.
The arbitrator's decision shall be final and binding on both parties. You and Vitavia agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. By agreeing to these Terms, you expressly waive your right to participate in any class action lawsuit or class-wide arbitration against Vitavia.
To the extent permitted by applicable law, you and Vitavia each waive any right to a jury trial in connection with any dispute arising out of or related to these Terms or the Services.
These arbitration and class action waiver provisions do not apply where prohibited by the laws of your jurisdiction of residence.
15. Severability & Entire Agreement
If any provision of these Terms is found to be unlawful, void, or unenforceable, such provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any remaining provisions.
These Terms, together with the Privacy Policy, Refund & Return Policy, and Shipping Policy, constitute the entire agreement between you and Vitavia regarding the use of our Services and supersede any prior agreements or understandings.
16. Changes to Terms
We may update these Terms at any time. Material changes will be communicated via our website or by email. The updated Terms will be effective upon posting, and the "Last Updated" date at the top of this page will be revised. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
