Vitavia™ ("Vitavia," "we," "us," or "our") operates this online store and website (the "Services"), which are hosted on the Shopify Inc. ("Shopify") e-commerce platform. Shopify provides the commerce technology supporting our checkout, security, and customer management systems, while Vitavia remains responsible for how your personal information is collected, used, and shared.

Vitavia does not intentionally collect sensitive personal information (e.g., health data, racial or ethnic origin, political opinions, biometric data). If you voluntarily provide such information (for example, in a product review), you consent to its processing solely for the purpose of fulfilling your request.


2. How We Use Your Information

We process your data for the following purposes:

  • SMS/Text Messaging: By providing your number and opting in, you agree to receive recurring automated marketing text messages (e.g., cart reminders, promotions) via an automatic telephone dialing system. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies.   • Personalization: We use cookies to track items in your shopping cart, including abandoned checkouts, to determine when to send cart reminder messages.

To the fullest extent permitted by applicable law, Vitavia's total liability for any data-security or privacy-related claim is limited to the total amount you paid for Vitavia products in the 12 months preceding the incident. This limitation does not apply where prohibited by law.


13. Governing Law & Dispute Resolution

This Privacy Policy is governed by the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Vitavia's principal place of business is located in Alberta, Canada.

Any disputes regarding this Policy are subject to the binding arbitration and class action waiver provisions found in our Terms of Service.

Nothing in this section limits any privacy or consumer protection rights that cannot be waived or limited under the laws of your jurisdiction of residence.


14. Changes to This Policy

We may update this Policy periodically. Material changes will be communicated via our website or by email. The updated Policy will be effective upon posting, and the "Last Updated" date at the top of this page will be revised. Continued use of our Services after an update constitutes acceptance of the revised Policy, except where applicable law requires your explicit consent for material changes to data processing.
